General Terms and Conditions
Scope of Application
a. These general conditions apply to contracts concerning TOURIST ACCOMMODATION (hotel rooms), including all services and supplies provided by the hotel in relation to such accommodation.
b. Conditions set by the contracting party apply only if explicitly agreed upon in writing in advance.Conclusion of the Contract and Contractual Content
a. Offers for TOURIST ACCOMMODATION (hotel) are always considered non-binding. The contract is deemed concluded upon acceptance by the HOTEL. The HOTEL may confirm the booking in writing at its discretion.
b. If the booking is made on behalf of third parties (hotel guests), the person who made the booking is jointly and severally liable for all obligations arising from the contract in favor of the HOTEL.
c. Subletting and renting the HOTEL rooms to third parties, as well as using them outside the scope of tourism, are prohibited without prior written consent from the HOTEL.
d. Unless otherwise agreed, rooms are available to the guest from 3:00 PM on the day of arrival (check-in) and must be vacated by 10:30 AM on the day of departure (check-out). Late check-out up to 5:00 PM may incur a previously agreed fixed fee. After 5:00 PM, a charge equal to 100% of the daily room rate will apply. This does not create contractual rights for the guest.Rates and Payment
a. The guest is required to pay for accommodation and/or EVENTS, as well as all other services used, according to the rates agreed with the HOTEL.
b. The guest must also pay for services provided by the HOTEL to third parties on the guest’s request. Services rendered after 11:00 PM may incur additional night-time service charges.
c. Unless otherwise agreed, rates include VAT. If more than four months elapse between the conclusion and performance of the contract, the HOTEL may reasonably increase the agreed price up to a maximum of 10%, in case of rate increases or VAT changes.
d. Invoices are issued in Euro. Any exchange rate differences or bank fees for foreign currency payments are borne by the guest. Deposits paid in foreign currency are deducted from the total invoice amount at the exchange rate on the deposit date.
e. Invoices must be paid within 5 days of receipt. Late payments may incur interest charges pursuant to Italian law (Legislative Decree 231/2000). The guest may provide proof of lesser damage; the HOTEL must prove greater damage.
f. The HOTEL may request a deposit at any time under Article 1385 of the Italian Civil Code. Unless otherwise agreed in writing, the following amounts are considered deposits: for bookings, 30% of the room price at the time of booking. The room is reserved only upon receipt of the deposit.
g. Any billing complaints must be immediately reported to the HOTEL.
h. The invoicing details (recipient) must be communicated to the HOTEL at the time of service assignment or no later than contract conclusion.Hotel’s Right of Withdrawal
a. If the agreed deposit is not received within an extended deadline set by the HOTEL, the HOTEL may withdraw from the contract.
b. The HOTEL may withdraw for justified reasons, without compensation, including:
force majeure or causes beyond the HOTEL’s control making contract fulfillment impossible;
bookings or EVENTS where essential elements (guest identity or event purpose) were misrepresented;
suspicion that accommodation or EVENTS might harm the HOTEL’s public reputation, unless caused by the HOTEL itself;
failure to comply with clause 2.c. (prohibited subletting or non-touristic use).
c. The HOTEL shall immediately notify the guest of the exercise of the withdrawal right.
Cancellations by Guests / Non-Performance / Early Departure
(Written form is required for cancellations)
a. EVENTS:
Cancellation up to 180 days before the event date is free, except a fixed €200 administrative fee.
Between 120 and 60 days prior, 50% of the agreed event price will be charged.
Within 60 days of the event, 100% of the agreed price is charged.
b. ACCOMMODATION:
Cancellation up to 30 days before arrival: free cancellation.
Between 30 and 15 days before arrival: 30% cancellation fee.
Between 15 and 7 days before arrival: 50% cancellation fee.
Less than 7 days before arrival or no-show: 100% cancellation fee.
c. Cancellation also applies to changes reducing the booked stay (late arrival or early departure).
d. In case of no-show or failure to cancel, the guest is obligated to pay 100% of the agreed price for the stay, including any catering or other included services.
e. Prices refer to the room, not the number of occupants; therefore, cancellation fees apply to the entire room if some beds are unoccupied or cancelled.
f. Early departure requires payment for the days stayed plus 100% of the price for remaining days.
Hotel Liability
a. The HOTEL is not liable except in cases of willful misconduct or gross negligence by the HOTEL or its representatives, or for failure to perform essential contractual obligations. Liability for minor negligence is limited to foreseeable damages related to the contract type. Liability for personal injury or harm to life and health remains unaffected.
b. The HOTEL is not responsible for guests’ personal belongings, with liability limited up to 100 times the room rate, pursuant to Article 1783 of the Italian Civil Code.Guest Responsibility
a. The guest is responsible for any damage caused to the HOTEL’s property or furnishings by themselves or their guests, family members, visitors, collaborators, or participants in EVENTS they organize. The guest is responsible for adequate insurance coverage.Final Provisions
a. Any modifications or additions to this contract must be in writing.
b. Written communications sent by the HOTEL to the guest’s last known address are considered delivered on the third day after postal delivery. Fax transmissions are proven by the fax protocol. This rule does not apply to communications sent by the guest to the HOTEL, which are only accepted by email and must be confirmed as received by the HOTEL. Personal delivery to the HOTEL requires confirmation (signature) by an authorized employee.
c. The place of contract performance and payment is the HOTEL’s premises.
d. The competent court for disputes, including those regarding bills of exchange and checks, is exclusively the court of VERONA (or Padua).
e. This contract is governed by Italian law.
